Terms and Conditions

Please read this page carefully. When you book your holiday with the owner you are entering into a contract, which binds you, and the owner in various ways.
Your holiday may be the most important purchase you make this year, so it is important that the obligations between you and the owner should be clear, concise and fair.

1.TERMS AND PRICES. You may commence occupation of your holiday home between 4.00pm and 7.00pm or such other time that is mutually agreeable (subject to any unavoidable delays). You must vacate by 10.00am on the day of departure. The owners shall not be obliged to offer the accommodation before the stated time nor shall the client be entitled to remain in occupation after the time stated. You are expected to leave your accommodation in a clean and tidy condition. A cleaning charge of will be deducted from your deposit if the property is not left in the condition in which you found it. All terms are per week. As soon as the booking is made by you and confirmed by the owners with the confirmation invoice, the hire terms are fully guaranteed and will not be subject to any surcharges. The prices quoted are in Sterling and payment is required by Sterling cheque.

2.MAKING A BOOKING. To reserve the property, the client should make a provisional booking by telephone and then forward the completed booking form and deposit within 7 days. The submission of the completed booking form shall constitute an offer by you and a contract shall come into existence when we issue a booking confirmation. For bookings within 8 weeks of the arrival date you must pay the full hire charge and all other costs at the time of booking.

2. PAYMENT OF BALANCE. The amount payable will be shown on the confirmation booking. It must be paid at least 8 weeks before your arrival date. If you fail to pay on time, the owners reserve the right to treat your holiday as cancelled by you. In this case we will retain your deposit and the provisions of clause 4 will apply.

3. INSURANCE. You must state the name of your insurer at the time of payment of your holiday balance. Please read your policy details carefully. Please ensure that you and your party have adequate insurance covering accident, loss and damage, as the use of all the facilities is at your own risk and we cannot accept responsibility for any such occurrences.

4. CANCELLATION BY YOU. In the unlikely event that you have to cancel your holiday you are required to telephone the owners immediately and send written confirmation on the same day by first class mail. Your cancellation is effective from the date that we receive your written confirmation, which will be acknowledged. If you cancel 56 days or more before your arrival date you will only forfeit your deposit. If you cancel less than 56 days before your arrival date you will be responsible for the balance, less any hire charges we may be able to recover through re letting. You must ensure that you obtain adequate insurance cover for cancellation or curtailment.

5. NUMBER OF PERSONS. Occupation of the property is restricted to persons on the reservation form.

6. WATER ELECTRICITY AND GAS. Are very expensive in France. Whilst normally no charge is levied during mid and high season we reserve the right to charge in cases of excessive consumption.

7. EXTRA COSTS. There will be an extra charge for bed linen and towels.

8. MINORS. Bookings from persons aged less than 18 years cannot be accepted.

9. ALL MALE OR FEMALE BOOKINGS. At the owners discretion.

10 UNSUITABLE HIRERS. The owners have the right to refuse to hand over the property to any person who, in their opinion is not suitable to take charge. In addition, the owners have the right to repossess the property at any time if in their opinion, you or any member of your party is unsuitable to remain in charge because of their age, ill health, disability, suspected or actual influence of alcohol or drugs, or any other reason, or because of irresponsible behaviour likely to cause danger to themselves, other persons or property. In this situation the owners will have no further responsibility or liability and no refunds, costs or expenses will be made or met.

11. AVAILABILITY. If the owners are prevented by circumstances beyond their control from making the property available and cannot provide a suitable alternative, they will refund monies already paid by you but no further liability will be accepted.

12. FORCE MAJEURE. The owners regret that they cannot accept liability and no compensation will be payable where the performance or prompt performance of our contract with you is prevented or affected by “force majeure”. In these Fair Trading Terms “force majeure” means any event which we could not, even with all due care have foreseen or avoided. Such circumstances may include war, riot, industrial action, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions and all similar events outside our control.

13. YOUR RESPONSIBILITY. The client agrees to be a considerate tenant and to take good care of the property, and to leave it in a clean and tidy condition at the end of the rental period. The client also agrees not to act in any way, which would cause disturbance to those, resident in neighbouring properties. You are asked to notify the owners of any problems or defects immediately they become apparent, to enable the owners to rectify them and to maintain the high standards set by the owners. You undertake to report and pay for any damages caused to the property or for equipment lost damaged, broken or stolen during your occupancy. You will be asked to pay a security deposit of £300.00 at the time of paying the balance of the rental, which will be reimbursed in full within 14 days of your departure by post. We reserve the right to deduct from this the cost of replacing any broken or missing items and any cost we have incurred in your breach of any of the terms and conditions. The sum reserved by this clause shall not limit the Client’s liability to the owners.

14. LIABILITY. The owner shall not be responsible to you or to anyone at the premises of Le Fresne, expressly or by implication with your authority for any accident happening or injury suffered, or for any damage to or loss to any chattels sustained at the premises.

15. COMPLAINTS PROCEDURE. In the unlikely event that you have reason to complain or experience any problem with your property you must immediately inform the owners, who will endeavour to resolve the problem as quickly as possible. If the problem is not speedily resolved to your satisfaction please notify the owners in writing. We regret that we cannot accept any liability if you fail to notify the complaint or claim entirely in accordance with this clause.
